  Hi everyone. it's been a while since i've posted a blog, so I apaligise.

  The question I have is if you get in trouble with the law, with what the jugde sentences you to what ever term of jail time and/or probation, depending on the charge, can they extend it? Meaning lets say you have to do 36 months of probation, can the jugde extend that buy law, even if you have done all the things the jugde has asked you to do, with no violations? I ask this cuz I know of someone who's kind of in a situation simuler to this. Can't go into details, lets just say that come this month, it'll be 36 months since they wher sentenced to serve that long on probation. It's called their "legislative date". It's driving them nuts. I tell them and their "DEFENSE ATTY" has toled them that what ever day it says you get off probation, that's the day you get off. Their P.O. hasn't realy said if they need to go to cort to have a Jugde signe off on it as well. So ya. If anyone has any coments about this, or has any idea about how the laws work, let me know. I'm curios.

As I understand the system, if there's restitution involved, they can keep you on probation until it's paid, but I don't think they can extend your sentence if you've met all requirements. There should be an official notice when it's over. I know someone who was hauled into jail on a bogus probation violation. They were officially free, but the "paperwork" wasn't complete yet. Be careful.

From what I know, yes they can. Just as long at the extended punishment doesn't exceed the maximum punishment for that crime. For example, if I am convicted of a misdemeanor crime, the longest I should be able to be locked up is 364 days, 1 day shy of a year. So, if I’m sentenced to 5 weeks in jail, but for what ever reason the sentencing judge says I have to go back for more, he can do that, just as long as my jail time doesn’t exceed the 364 days.

Something like this actually happened to an acquaintance of mine. He was just about to get out of jail after serving 2 ½ months in county lock up. One week before he was due out, he sent a letter to his girlfriend in which he called the judge an “f-ing idiot”. Of course mail is screened, this got back to the judge and the judge felt as if though this guy had not learned his lesson, so he doubled the original sentence. Of course, being ordered to not call the judge names was not a part of his sentence, but he was punished for it regardless. A bad attitude can get you in trouble, maybe this is your friend’s issue.

Thanks for your comment. Sounds like everyone's right in their answers for my freind. Their doing better with the subject at hand, but you know how some one can worry about their past and how it still affects them. This has been going on for four years now for them and they just want to put it behind them. I've been their befor, not like them, but still, it realy sucks to be in any situation with the law.
